By virtue of an Order of Sale No. CV2018 03 1305 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 19TH DAY

OF OCTOBER, A.D., 2018

 

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Tallmadge, County of Summit and State of Ohio, and known as being part of Original Lot No. Nine (9), Tract No. Eleven (11) formerly Tallmadge Township, further bounded and described as follows, to-wit:

Beginning at a point in the Northeast line of said Original Lot No. Nine (9) and the Southwest line of Southeast Avenue which point is North 46'' 33' West, a distance of 1358.00 feet from the Northwest line of the General Gardens Allotment, as recorded in Plat Book 37, Page 76 of Summit County Records; thence South 44" 49' West, parallel to the Northwest line of said the General Garden Allotment, a distance of 1 041.24 feet to a point; thence North 46" 33' West, parallel to the Northeast line of said Original Lot No. Nine (9), a distance of 1199 feet to a point and the true place of beginning of the land herein described; thence North 46" 33' West, continuing parallel to the Northeast line of said Original Lot No. Nine (9), a distance of 145 feet to a point; thence North 44" 49' East, 509.41 feet to a point in the Southerly line of a 8.0 acre parcel of land conveyed to Robert Amacher by deed recorded in Volume 482, Page 125 of Summit County Records; thence South 47" 03' East along the Southerly line of said 8.0 acre parcel of land, 145 feet to a point; thence South 44" 49' West, parallel to the Northwest line of said the General Gardens Allotment 510.67 feet to the true place of beginning, be the same more or less, but subject to all legal highways.

Property located at: 672 S. Elm Avenue, Tallmadge, OH 44278.

Property appraised at: One Hundred Thirty-two Thousand Dollars ($132,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 2nd day of November, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
