By virtue of an Order of Sale No. CV2017 05 2204 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Boston, County of Summit and State of Ohio:

Being part of Lots 7 & 8 in said township and bounded and described as follows:

Beginning at a 1" iron bar in a monument box found at the intersection of the centerlines of S.R. 8, Akron-Cleveland Road and T.R. 120, Kendall Park Road; thence N. 89 deg. 41' 30" W., along the centerline of T.R. 120, a distance of 1517.21 feet to a point at the Northwesterly corner of land now or formerly owned by M. M. Korba (Vol. 6575, Page 805) which marks the true place of beginning for the following described parcel of land; thence S. 00 deg. 10' 54" W., along the Westerly line of said Korba (crossing the line between Lot 7 & Lot 8), a distance of 771.82 feet to a 1" iron bar found in the Northerly line of land now or formerly owned by R. D. Mazzola, Jr. (Vol. 7507, Page 625); thence N. 89 deg. 48' 49" W., along Mazzola's said Northerly line and the Northerly line of land now or formerly owned by G. P. Baur (OR 1361/555) & (OR 1177/720), a distance of 300.00 feet to a 5/8" iron rod set at the Southeasterly corner of land now or formerly owned by P. J. & S. Klaczko (Vol. 6992, Page 137); thence N. 00 deg. 10' 54" E., along the Easterly line of said Klaczko (crossing the line between Lot 6 and Lot 7), a distance of 336.40 feet to a 5/8" iron rod set; thence S. 89 deg. 41' 30" E., a distance of 200.00 feet to an 5/8" iron rod set; thence N. 00 deg. 10' 54" E., (passing over a 1" iron pipe found at 406.00 feet), a distance of 435.00 feet to a point in the centerline of T.R. 120; thence S. 89 deg. 41' 30" E., along the centerline of T.R. 120, a distance of 100.00 feet to the true place of beginning, containing 3.3159 acres of land, more or less, of which 2.1919 acres, more or less, are in Lot 7 and 1.1240 acres, more or less, are in Lot 8 as surveyed June 27, 1996, by Rob A. Szuch, Registered Professional Surveyor No. 7288. The bearings for the centerline of Kendall Park Road of N. 89 deg. 41' 30" W. was taken from OR 2182/1099. Be the same more or less, but subject to all legal highways. Subject to all easements, conditions, restrictions, and reservations of record.

Property appraised at: Three Hundred Thousand Dollars ($300,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 2nd day of November, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
