By virtue of an Order of Sale No. CV2017 11 4854 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 14TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

PARCEL NO. 1:

Situated in the Village of Northfield, County of Summit and State of Ohio, being part of vacated Electric Boulevard and, part of a 100' wide strip of land between Electric Boulevard as shown on the R. B. Hartwig's Liberty Park Subdivision as recorded in Plat Book 25, Pages 14, 15 & 16 of the Summit County Plat Records, and being the same parcels conveyed to Betty J. Worrell (P.N. 4101923, P.N. 4101922, P.N. 4101921 and P. N. 4101920) and recorded in Deed Volume 6791, Page 664 of the Summit County Deed Records, and more fully bounded and described as follows:

Beginning at a 5/8" iron pin found at the Southwest corner of Lot 437 in said R. B. Hartwig's Liberty Park Subdivision; thence S. 89 deg. 29' 55" E., along a Southerly line of said Lot 437 and a Southerly line of Lots 436 and 433, in said R. B. Hartwig's Liberty Park Subdivision, a distance of 220.96 feet to point which is witnessed by a pinched pipe found that bars N. 67 deg. 43' 29" W., 0.26 feet, said point being the true place of beginning for the parcel of land herein described;

Course No. 1:

Thence N. 05 deg. 22' 52" W., along Easterly lines of parcels conveyed to Stjepan & Ana Posavec (P.N. 4100567, P.N. 4100568 and P.N. 4100566) and recorded in Reception No. 55098602 of the Summit County Deed Records, a distance of 124.40 feet to a point which is witnessed by a 1/2" iron pin found that bears N. 02 deg. 45' 20" W., 0.19 feet;

Course No. 2:

Thence S. 89 deg. 33' 48" E., along a Southerly line of Birch Avenue (40') a distance of 101.45 feet to a pinched pipe found;

Course No.3:

Thence along a Southwesterly line of said Birch Avenue, along the arc of a curve to the right with a detangle of 84 deg. 09' 39", having a radius of 10.00 feet, a chord bearing of S. 47 deg. 28' 59" E., a chord length of 13.40 feet, and the arc distance of 14.69 feet to a pinched pipe found;

Course No. 4:

Thence S. 05 deg. 24' 09" E., along a Westerly line of Electric Boulevard (40'), a distance of 115.50 feet to an illegible capped iron pin found;

Course No. 5:

Thence N. 89 deg. 29' 55" W., along a Northerly line of a parcel conveyed to Eric C. Puff and Carrie A. Puff (P.N. 4100277) recorded in Reception No. 55558076 of the Summit County Deed Records, a distance of 110.54 feet to the true place of beginning and containing 0.314 acres of land, more or less, of which 0.005 is in (P.N. 4101922), 0.005 acres is in (P.N. 4101921), 0.005 acres is in (P.N. 4101920) and 0.299 acres is in (P.N. 4101923), as surveyed by Joshua C. Lambert, P.S. Ohio Registration No. S-8666, for Diversified Engineering Inc., in July, 2018, but subject to all legal roads, highways, right of ways, easements and leases of record.

The basis of bearing is Ohio State Plat Coordinates, North Zone, NAD 1983. All iron pins set are 30 inch X 3/4 inch round steel bars with plastic caps stamped "Diversified Engineering".

PARCEL NO. 2:

Situated in the Village of Northfield, County of Summit and State of Ohio and known as being part of Liberty Park Subdivision as recorded in Plat Book 25, Pages 14 and 15 of the Summit County Records of Plats; beginning at the Southeast corner of Lot No. 433 of said Liberty Park Subdivision; thence Easterly parallel to Birch Avenue, a distance of 10.05 feet to the place of true beginning; thence Northerly parallel to the West line of West Electric Blvd. and the East line of Lots 433, 434 and 435, a distance of 124.64 feet to a point on the South line of Birch Avenue; thence Easterly along the South line of Birch Avenue, a distance of 5.02 feet to a point; thence Southerly parallel to the center line of Electric Blvd., a distance of 124.64 feet to a point; thence Westerly parallel to Birch Avenue, a distance of 5.02 feet to the place of beginning and containing 623.2 square feet of land.

Property located at: 10338 Electric Boulevard and V/L Electric Boulevard, Northfield, OH 44067.

Property appraised at: One Hundred Eight Thousand Dollars ($108,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 28th day of December, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
