By virtue of an Order of Sale No. CV2018 07 3122 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 21ST DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Tallmadge, County of Summit and State of Ohio:

And known as being part of Original Lot 3, Tract 16, formerly Tallmadge Township, further bounded and described as follows; to-wit:

Beginning at the point of intersection of the center line of the Cuyahoga Falls-Mogadore Road and the East Akron-Brimfield Road; thence South 51 deg. 57' West along the center line of said East Akron-Brimfield Road, a distance of 550 feet to the true place of beginning of the land herein described; thence South 45 deg. 11' East parallel to the center line of said Cuyahoga Falls-Mogadore Road, a distance of 334.75 feet to an iron pipe (an iron pipe is set on this line at the Southeast line of said East Akron-Brimfield Road); thence North 88 deg. 43' West parallel to the South line of said Original Tract 16, a distance of 115 feet to an iron pipe; thence North 42 deg. 45' West, a distance of 260.15 feet to a point in the center line of said East Akron-Brimfield Road, (an iron pipe is set on this line at the Southeast line of said East Akron-Brimfield Road); thence North 51 deg. 57' East along the center line of said East Akron-Brimfield Road, a distance of 68.71 feet to the true place of beginning and contains 0.51 acres of land, be the same more or less, but subject to all legal highways, as surveyed by W. S. Mathews in December, 1947.

Property appraised at: One Hundred Twenty-six Thousand Dollars ($126,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 4th day of January, 2019. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
