By virtue of an Order of Sale No. CV2010 06 4174 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

And known as being the Easterly 55.01 feet of the following described property, being a part of Lot 7, Tract 8, (formerly Springfield Township) and described as follows:

Beginning the Northwest corner of said Lot 7; thence North 89 deg. 09' 27" East, a distance of 1264.39 feet of the lot line; thence South 0 deg. 50' 33" East, a distance of 628.50 feet; thence North 89 deg. 10' 27" East, a distance of 315.00 feet to the place of beginning for the land herein described; also known as 3476 Ellen Drive (land is approximately 55 x 397); thence North 89 deg. 09' 27" East, a distance of 105.00 feet; thence South 0 deg. 50' 33" East, a distance of 395.63 feet; thence South 88 deg. 15' 51" West, a distance of 105.01 feet; thence North 0 deg. 50' 33" West, a distance of 397.27 feet to the place of beginning, containing 0.9556 of an acre. This deed is given to complete the land contract recorded in Vol. 5643, Page 818 of Summit County Records.

Property appraised at: One Hundred Two Thousand Dollars ($102,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 11th day of January, 2019. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
