By virtue of an Order of Sale No. CV2018 08 3366 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 28TH DAY

OF DECEMBER, A.D., 2018

 

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Lot 6, Tract 5, formerly Tallmadge Township and bounded and described as follows:

Beginning at the Northwest corner of Lot 126 of the Northside Park Subdivision as recorded in Plat Book 30, Pages 68 and 69, Summit County Records and being also on the West line of Lot 6, Tract 5; thence North 57 deg. 27' East, along the West line of Lot 6, a distance of 551.47 feet to a point; thence South 84 deg. 48' East and parallel to the North line of said Northside Park Subdivision, a distance of 500 feet to an iron stake; thence South 5 deg. 27' West, a distance of 268.41 feet to a point and the true place of beginning; thence South 84 deg. 58' East, a distance of 230 feet to an iron stake; thence South 5 deg. 27' West, a distance of 60 feet to an iron stake; thence North 84 deg. 58' West, a distance of 230 feet to a point; thence North 5 deg. 27' East, a distance of 60 feet to a point and the true place of beginning as surveyed by Jesse A. Bonzo in June 1958. The Grantor restricts the use of the Westerly 50 feet of the above described parcel. The same being a part of a private roadway to be used in common with others for roadway purposes only. The above described premises further known as being a part of Lot No. Par 9 of the Northview Unrecorded Allotment.

Property appraised at: Sixty-six Thousand Dollars ($66,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 11th day of January, 2019. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
