By virtue of an Order of Sale No. CV2018 02 0672 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 29TH DAY

OF JUNE, A.D., 2018

 

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio and known as being part of Lot No. 6, Tract 4, formerly Springfield Township and more fully described as follows:

Commencing at the intersection of the East line of Tract 4 and the center line of Hilbish Ave., with the N. line of Lot No. 20, produced Easterly of Peterboro Subdivision as recorded in Plat Book 35, Pages 36 and 37, Summit County Records of Plats; thence N. 4 deg. 29' E. along the East line of Tract 4 and center line of Hilbish Avenue 733.10 feet to the center line of Faye Road; thence N. 85 deg. 54' W., along the center line of Faye Road 978.78 feet to the true place of beginning of land described hereby; thence North 85 deg. 54' W. along the center line of Faye Road 70 feet; thence N. 4 deg. 29' East 255.00 feet to an iron pipe; thence South 85 deg. 54' E. 70 feet to an iron pipe; thence S. 4 deg. 29' West 255.00 feet to the true place of beginning and containing, as surveyed in August, 1955, by S. G. Swigart and Son, 0.4098 of an acre of land. Reserving from the above described premises the S. 25 feet thereof for highway purposes.

Property appraised at: One Hundred Two Thousand Dollars ($102,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 13th day of July, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
