By virtue of an Order of Sale No. CV2017 02 0749 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 29TH DAY

OF JUNE, A.D., 2018

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Fairlawn, County of Summit and State of Ohio:

And being known as a part of Lot No. 14 formerly Copley Township and described as follows:

Beginning at the Southeast corner of Lot No. 14 and running thence North a distance of 512.72 feet on the lot line; thence West, a distance of 427.50 feet to the place of beginning for the land herein described; thence West, a distance of 427.50; thence North, a distance of 120 feet; thence East, a distance of 427.50 feet; thence South, a distance of 120 feet to the place of beginning, as shown by a survey made by C. L. Bushey, Surveyor in January 1938, Vol. 1778, Pg. 283. Reserving 25 feet off the West end of the above lot as a private drive for this and other lots of the Allyn Farm. Excepting that part of the above described premises which were conveyed to the State of Ohio in Case No. 287329 Judgment Entry filed in Volume 5297, Page 200 of Summit County Records, as follows:

Situated in the City of Fairlawn, Lot No. 14, Town 2 North, Range 12 West, Copley Township, Summit County, Ohio, lying on the right side of the centerline of the survey made by the department of highways, and recorded in Volume 75, Pages 10-21 of the records of Summit County, Ohio and being more fully described as follows:

Parcel No. 28-WL (highway) all right, title and interest in fee simple in the following described property:

Commencing at the Southeast corner of the aforesaid Lot 14; thence South 89 deg. 39' 26" West, on the South line of said Lot 14, a distance of 855.00 feet to the center of Winchester Road; thence North 00 deg. 28' 04" West on the center of Winchester Road, a distance of 510.78 feet to the true place of beginning of the tract of land described herein which is 94.00 feet right of the centerline Survey Station 385 plus 13.79 and being the owners' Southwest property corner; thence North 00 deg. 28' 54" West on the owners' Westerly property line which is also the centerline of Winchester Road, a distance of 88.84 feet to a point in the Easterly proposed right of way line of Interstate Route 77; thence South 57 deg. 52' 24" East on said limited access line, a distance of 164.40 feet to a point on the owners' Southerly property line; thence South 89 degrees 24' 35" West on the owners' Southerly property line, a distance of 138.52 feet to the true place of beginning, and containing 0.14 of an acre of land of which 0.10 of an acre is to be acquired and 0.04 of an acre is within the existing highway right of way. Description for the above parcel is based on a survey made by W. E. Quicksall, Jr., Registered Surveyor No. 4710, made June 6, 1973.

Note: The 26 foot reservations which is part of the legal description now forms a part of the Easterly half of Winchester Road, a dedicated 50 foot street which dedication appears in Plat Book 46, Page 84 of Summit County Plat Records.

Property appraised at: One Hundred Twenty Thousand Dollars ($120,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 13th day of July, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
