By virtue of an Order of Sale No. CV2017 10 4267 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Tallmadge, County of Summit and State of Ohio and known as being part of Lot #14, Tract 16 of Original Tallmadge Township, further bounded and described as follows:

Beginning at a point on the center line of Southeast Avenue, S.R. 532, formerly known as Cuyahoga Falls-Mogadore Road, and the Southwest corner of land as conveyed to D. T. & D. A. Petty by deed recorded in Deed Book Volume 6303, Page 127, Summit County Records, said point being North 45 deg. 07' 00" West, a distance of 350.00 feet from a 1" rod in a monument box found at the center line intersection of said Southeast Avenue and Newton Street, formerly known as Akron-Brimfield Road; thence along the center line of Southeast Avenue, North 45 deg. 07' 00" West, a distance of 80.00 feet to a point; thru the Grantors land, North 53 deg. 07' 00" East passing over a 5/8" rebar w/cap 6541 set flush this survey at 30.31 feet from center line, a total distance of 628.17 feet to a 5/8" rebar w/cap 6541 set 2" high this survey on the Southwesterly line of land as conveyed to J. Harvey by deed recorded in Deed Book Volume 6782, Page 858, Summit County Records; thence along Harvey's Southwesterly line, South 45 deg. 07' 00" East, a distance of 80.00 feet to a 5/8" rebar w/cap 6541 set 2" high this survey at the Northwest corner of land conveyed to D. T. & D. A. Petty; thence along Petty's Northwesterly line, South 53 deg. 07' 00" West passing over a 5/8" rebar w/cap 6541 set flush this survey at 597.86 feet, a total distance of 628.17 feet to the place of beginning and containing 1.1418 acres of land, be the same more or less, but subject to all legal highways, rights and easements of record, as surveyed in June 1986 by John W. Patrick, Jr., Professional Land Surveyor #6541. The bearing of North 45 deg. 07' 00" West along the center line of Southeast Avenue, as described in the Grantors deed, as recorded in Deed Book Volume 2724, Page 258, was used as the "basis of bearings" for this survey and legal description.

Property appraised at: One Hundred Eleven Thousand Dollars ($111,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 13th day of July, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
