By virtue of an Order of Sale No. CV2018 03 1079 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 13TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the State of Ohio, County of Summit and City of Tallmadge:

And known as being part of Lot 3, Tract 4, formerly Tallmadge Township, and also known as being part of that parcel conveyed to Loney L. and Marjorie Kline as recorded in Official Record 656, Page 199 and part of that parcel conveyed to Loney L. Kline, Jr. as recorded in Official Record 656, Page 198 and being more fully bounded and described as follows:

Beginning, for reference, in the center line of Northeast Avenue (60 feet right of way) at its intersection with the South line of Lot 3; thence North 43 degrees 11 minutes 24 seconds East, 1285.32 feet, along said center line to angle point therein; thence North 43 degrees 29 minutes 24 seconds East, continuing along said center line (passing over the center line intersection of Atwood Drive at 20.10 feet) a distance of 770.18 feet to the true place of beginning for the parcel hereinafter described (witness a 5/8 inch rebar with cap set South 46 degrees 48 minutes 36 seconds East, a distance of 30.00 feet); thence North 43 degrees 29 minutes 24 seconds East, continuing along said center line 217.99 feet to a point; thence South 46 degrees 48 minutes 36 seconds East, along a new division line, a distance of 295.36 feet to a 5/8 inch rebar with cap set in the Westerly line of a parcel conveyed to Mindale Farms Co. as recorded in Reception No. 54341669 (passing over a 5/8 inch rebar with cap set at 30.00 feet); thence South 43 degrees 30 minutes 38 seconds West along the line of said Mindale Farms Co. parcel, a distance of 217.99 feet to a 3/4 inch pinched top pipe found in the Northerly line of a parcel conveyed to Loney L. Kline, Jr. as recorded in Deed Volume 5117, Page 112; thence North 46 degrees 48 minutes 36 seconds West, along said North line, a distance of 295.28 feet to the true place of beginning and containing 1.478 acres of land (on which 0.150 acres lies in right of way), more or less, as determined by a survey made under the direction of Stephen P. Campbell, P.L.S. No. 7830 of Campbell & Associates, Inc. in September 2003. The basis of bearings for this description is State Plane Grid North Ohio North Zone.

Property located at: 1566 Northeast Avenue, Tallmadge, OH 44278.

Property appraised at: One Hundred Ninety-two Thousand Dollars ($192,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 27th day of July, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
