By virtue of an Order of Sale No. CV2018 01 0228 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 13TH DAY

OF JULY, A.D., 2018

 

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio and known as being part of Lot No. 10 in the Summit Lake Allotment as shown by the recorded plat of said allotment in the records of the Recorder's Office of Summit County, Ohio in Plat Book 11, Pages 2 and 3, more fully bounded and described as follows, to wit:

Beginning at the intersection of the East line of Manchester Road with the North line of Leslie Avenue; thence Easterly along the North line of Leslie Avenue 85 feet; thence Northerly parallel with Manchester Road 40 feet; thence Westerly parallel with the Leslie Avenue 85 feet; thence Southerly along the Easterly line of Manchester Road 40 feet to the place of beginning. Excepting therefrom the following:

Being a part of Lot 10 in the Summit Lake Allotment, Plat Book 11, Page 2-3 of the Summit County Record of Plats and being a corner rounding needed for sidewalk purposes more fully described as follows:

The true place of beginning being the Southwest corner of said Lot 10; thence Northwesterly along the East line of Manchester Road (60' R/W) North 14 deg. 50' 50" West 6.00 feet to a point of curve; thence Southeasterly through Lot 10 and along the arc of a circle curving to the left (central angle = 90 deg. 00' 12", radius = 6.00', chord = 8.49', chord bearing = South 59 deg. 50' 54" East) 9.43 feet to the North line of Leslie Avenue (45' RNV); thence Southwesterly along the North line of Leslie Avenue, South 75 deg. 00' 00" West 6.00 feet to the true place of beginning for the land hereinbefore described and containing 7.73 square feet as surveyed by the City of Akron, Bureau of Engineering, in March of 1994. The bearings in the above description are based on Ohio Plane Coordinate System, North Zone.

Property appraised at: Forty-two Thousand Dollars ($42,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 27th day of July, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
