By virtue of an Order of Sale No. CV2017 08 3642 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 27TH DAY

OF JULY, A.D., 2018

 

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Bath, County of Summit and State of Ohio and known as being a part of Lot 46 and described as follows:

Beginning at a cross in the center of the 80 feet right of way of Route 21 and also known as Cleveland-Massillon Road, and the Bath-Stow Road; thence South 85 degrees 28' East 2489.65 feet to a point in the center of the Slag Road and place of beginning; thence North 5 degrees 32' East, a distance of 740.13 feet to a point; thence South 85 degrees 48' East, a distance of 100 feet to a point; thence South 5 degrees 32' West the distance of 740.65 feet to a point in the center of the Bath-Stow Road; thence North 85 degrees 28' West, a distance of 100 feet to a point in the center of the Slag Road and being known as the true point of beginning. Said tract of land contains 1.70 acres of land. Be the same more or less, but subject to all legal highways.

Property appraised at: One Hundred Eighty Thousand Dollars ($180,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 10th day of August, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
