By virtue of an Order of Sale No. CV2019 05 1941 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

And being part of Original Lot Number Five (5), Tract Number Sixteen (16), formerly Tallmadge Township, further bounded and described as follows, to-wit:

Beginning at a point of intersection of the center lines of the Cuyahoga Falls-Mogadore Road and the East Akron-Brimfield Road; thence South 51 deg. 57' West along the center line of said East Akron-Brimfield Road; thence a distance of 802.25 feet to a point of curve; thence Southwesterly, continuing along the center line of said East Akron-Brimfield Road on a curve to the right having a radius of 573.65 feet, a central angle of 35 deg. 52', a chord which bears South 69 deg. 53' 30" West, 353.43 feet, a distance of 358.75 feet to a point of tangent; thence South 87 deg. 51' West, continuing along the center line of said East Akron-Brimfield Road, a distance of 1188.29 feet to the Northwest corner of a 51.888 acre parcel of land conveyed to Francis A. Sackett by deed recorded in Volume 1838, Page 387 of Summit County Records; thence South 0 deg. 10' West along the line of said 51.888 acre parcel of land, a distance of 1078.88 feet to a point and the true place of beginning of the land herein described; thence South 0 deg. 10' West, continuing along the West line of said 51.888 acre parcel of land, a distance of 100.00 feet to a point; thence South 88 deg. 43' 30" East parallel to the South line of said Original Lot Number Five (5), a distance of 486.60 feet to a point; thence North 0 deg. 10' East parallel to the West line of said 51.888 acre parcel of land, a distance of 100.00 feet to a point; thence North 88 deg. 43' 30" West parallel to the South line of said Original Lot Number Five (5), a distance of 486.60 feet to the true place of beginning and contains 1.12 acre of land, be the same more of Broadview Acres Number 2, un-recorded.

Property appraised at: Two Hundred Ten Thousand Dollars ($210,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 24th day of January, 2020. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
