By virtue of an Order of Sale No. CV2019 01 0346 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of New Franklin, County of Summit and State of Ohio:

Known as being part of the Northwest corner of the Northwest quarter of Section 36 and further described as follows:

Beginning at the Northwest corner of the Northwest quarter of 36 at a two in pin; thence along the West line of said section, S. 00 deg. 05' 00" E., a distance of 821.04 feet to a point on the centerline of Ott Drive, 50.00 feet wide; thence with the centerline of said road S. 81 deg. 20' E., a distance of 100.00 feet to a point and the true place of beginning; thence continuing with the said centerline, S. 81 deg. 20' E., a distance of 139.75 feet to a point; thence S. 00 deg. 05' 00" E., a distance of 1838.41 feet to a point, said point not accessible due to swampy conditions, and passing over a M.A.G. nail set at 25.29 feet; thence N. 85 deg. 41' 00" W., a distance of 237.66 feet to a one and one half inch close top pin found; thence with the West line of said Section 36, N. 00 deg. 05' 00" W., a distance of 1216.44 feet to a pin set; thence S. 89 deg. 55' 00" E., a distance of 98.83 feet to a pin set; thence N. 00 deg. 05' 00" W., a distance of 625.00 feet to the true place of beginning and passing over pin set at 25.29 feet from said P.O.B. The above described tract of land contains 8.6150 acres of land, more or less, but subject to all legal highways, easements and restrictions of record, if any, as surveyed and determined from local deeds and monumentation in January 1998, pins set are #4 rebar and caps (D. Bedore 6023), by Douglas E. Bedore, Professional Surveyor 6023. Bearings are to an assumed meridian and are used to denote angles only. The property address and tax parcel identification number listed herein are provided solely for information purposes, without warranty as to accuracy or completeness.

Property appraised at: One Hundred Forty-seven Thousand Dollars ($147,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 24th day of January, 2020. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
