By virtue of an Order of Sale No. CV2019 04 1524 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

The following real property, situated in the Township of Springfield, County of Summit and the State of Ohio:

And known as being a part of Original Lots 21 and 22 in said township and more fully described as follows:

Beginning at a point in the centerline of Albrecht Avenue (County Highway No. 44) where it is intersected by a reference line which is 5.00 feet West of the Easterly line of Ewart Road (County Highway No. 161) as indicated on sheet 2 of the Ewart's Road plans on file in the county engineer's office; thence S. 01 deg. 22 min. W., along the said reference line and 5.00 feet Westerly from the Easterly line of Ewart Road, a distance of 2093.96 feet to an angle point in the centerline of Ewart Road; thence N. 89 deg. 19 min. 30 sec. W., along the centerline of Ewart Road, a distance of 198.23 feet to another point in the centerline of Ewart Road the true place of beginning of the parcel herein described; thence N. 89 deg. 19 min. 30 sec. W., along the centerline of Ewart Road, a distance of 90.00 feet to a point; thence N. 00 deg. 31 min. E., a distance of 208.09 feet to a point; thence S. 89 deg. 29 min. E., a distance of 90.00 feet to a point; thence S. 00 deg. 31 min. W., a distance of 208.34 feet to the place of beginning and containing an area of 0.4302 acres as determined in November, 1968 by Emmet J. McDonald, Registered Surveyor, be the same more or less, but subject to all legal highways.

Property appraised at: Ninety Thousand Dollars ($90,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 13th day of March, 2020. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
