By virtue of an Order of Sale No. CV2019 08 3076 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 10TH DAY

OF APRIL, A.D., 2020

 

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

Being a part of Lot 3 in Tract 8 and bounded as follows:

Beginning at a point in the South line of E. Exchange St. 313-1/2 feet West of the West line of Arlington St.; thence S. 0 deg. 30' E. on the West line of Forrest Street 100 feet; thence West parallel to Exchange St. 35 feet; thence N. 0 deg. 30' W. parallel to Forrest St. 100 feet; thence East along line of Exchange St. 35 feet to the place of beginning, containing .08 of an acre of land, also the right to use a 12 foot alley in the rear of the above described premises in common with others; also a part of the above described premises being in Lot 3, Tract 8 commencing in the S. line of E. Exchange St. at a point 37 feet W. from the W. line of Forrest St.; thence S. parallel to the W. line of Forrest St. 100 feet to the N. line of an alley; thence E. 2 feet; thence N. parallel to the W. line of Forrest St. 100 feet; thence W. on the S. line of E. Exchange St. 2 feet to the beginning. Being the same premises as those transferred by Frank J. Knapp and Catherine Knapp to Fred J. Lefever deed for which transfer was recorded May 7th, 1896, in Vol. 221, Page 552, Summit County Records. The right is hereby reserved to Frank J. and Catherine Knapp, their heirs and assigns to use the same premises for sewer, water, gas and electrical purposes in connecting their land S. of an alley with E. Exchange SE. with the right to repair and so far as necessary to go on the land of the Grantee. Excepting therefrom the following portion of the above described premises. Situated in the City of Akron, County of Summit and State of Ohio and known as a part of land having a frontage of about thirty-five (35) feet at the Southwest corner of Forrest and E. Exchange Sts. and more fully described as follows:

Beginning at the Southwest corner of Forrest and E. Exchange St.; thence Southerly along the Western line of Forrest St. to a point twelve (12) feet South of and measured at right angles to, the South line of East Exchange St.; thence Westerly along a line parallel to the South line of East Exchange St. about thirty-five (35) feet to a point in the dividing line between lands now or formerly owned by M. Lurie and Mary Ruckel; thence Northerly, along said dividing line to the South line of E. Exchange St.; thence Easterly along the South line of E. Exchange St. about thirty-five (35) feet to the place of beginning, containing about 420 square feet of land.

 

Property located at: 878 E. Exchange Street, Akron, OH 44306.

Property appraised at: Thirty-nine Thousand Dollars ($39,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 24th day of April, 2020. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
