By virtue of an Order of Sale No. CV2019 09 3507 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

Situated in the City of Tallmadge, County of Summit and State of Ohio, and known as being a part of Original Lot 8 in Tract 7, formerly Tallmadge Township, and more fully described as follows:

Beginning at an iron pipe on the North line of the Akron-Youngstown Road (State Route 18), which is 3.00 feet South of and North 88 degrees 36' West, along the said Northerly line of the road, a distance of 68.70 feet from the original Southeast corner of said Lot 8; thence North 88 degrees 36' West, continuing along the Northerly line of the Akron-Youngstown Road, a distance of 75.00 feet to an iron pipe; thence North 01 degree 18' East, a distance of 433.70 feet to an iron pipe; thence South 87 degrees 51' East, a distance of 75.01 feet to an iron pipe; thence South 01 degrees 18' West, a distance of 432.71 feet to the place of beginning. Containing 0.7459 acres of land, more or less, as surveyed June 23, 1948 by Emmet J. McDonald, Registered Surveyor.

Beginning at an iron pipe on the North line of the Akron-Youngstown Road (State Route 18) which is 3.00 feet South of and North 88 degrees 36' West along the said Northerly line of the road, a distance of 143.70 feet from the original Southeast corner of said Lot 8; thence North 88 degrees 36' West, continuing along the Northerly line of the Akron-Youngstown Road, a distance of 75.00 feet to an iron pipe; thence North 01 degree 18' East, a distance of 434.68 feet to an iron pipe; thence South 87 degrees 51' East, a distance of 75.01 feet to an iron pipe; thence South 01 degree 18' West, a distance of 433.70 feet to the place of beginning. Containing 0.7476 acres of land, more or less, as surveyed June 23, 1948 by Emmet J. McDonald, Registered Surveyor.

Excepting from the above parcels the following described property:

Commencing at an intersection of the existing centerline of Cambrian Drive with the existing centerline of East Avenue; thence North 88 degrees 36' 00" West along the existing centerline of East Avenue, 176.80 feet to a point; thence North 01 degree 24' 00" East, 30.00 feet to a point at the Grantor's Southeast property corner, said point being on the existing Northerly right-of-way line of East Avenue, said point also being 30.00 feet left of centerline Station 21 + 17.86 and being the true place of beginning; thence North 88 degrees 36' 00" West along the existing Northerly right-of-way line of East Avenue and the Grantor's Southerly property line, 150.90 feet to a point at the Grantor's Southwest property corner; thence North 01 degree 18' 00" East along the Grantor's Westerly property line, 10.00 feet to a point on the proposed Northerly right-of-way line of East Avenue; thence South 88 degrees 36' 00" East along said proposed right-of-way line, 150.90 feet to a point on the Grantor's Easterly property line; thence South 01 degree 18' 00" West along said property line, 10.00 feet to the true place of beginning. Containing 1,590 square feet of land, more or less. Grantor reserves the right of ingress and egress to and from East Avenue.

Property located at: 187 East Avenue, Tallmadge, OH 44278.

Property appraised at: One Hundred Forty-one Thousand Dollars ($141,000.00).

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at

on the 28th day of August, 2020. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
