By virtue of an Order of Sale No. CV2018 01 0379 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 24TH DAY

OF AUGUST, A.D., 2018

 

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Springfield, County of Summit and State of Ohio, and known as being a part of Lot 6, Tract 4 in said township and bounded and described as follows:

Beginning at the point of intersection of the center line of Berger Drive with South line of the Airport Gardens Allotment as recorded in Plat Book 41, Page 73 of Summit County Records of Plats; thence South 02 deg. 23' East along the center line of Berger Drive (proposed) a distance of 300 feet to a point and the true place of beginning; thence continuing South 02 deg. 23' East, 100 feet to a point; thence at right angles South 87 deg. 37' West, 251.33 feet to an iron stake; thence North 00 deg. 59' East, 100.17 feet to an iron stake; thence North 87 deg. 37' East, a distance of 245.45 feet to a point on the center line of Berger Drive (proposed) and the true place of beginning. Containing within said boundaries 0.57 of an acre of land. Excepting and reserving a strip of land 25 feet in width off the entire East said of the above described parcel, the same to be used in common with others for roadway purposes only.

Note: Notwithstanding the reference to acreage or square footage in the description set forth in Schedule A hereof, this policy does not insure nor guarantee the acreage or quantity of land set forth therein.

Property located at: 1760 Berger Drive, Akron, OH 44312.

Property appraised at: Sixty Thousand Dollars ($60,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 7th day of September, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
