By virtue of an Order of Sale No. CV2006 04 2397 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 31ST DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

And known as being a part of the Northeast quarter of Section No. 25 and bounded and described as follows:

Beginning at a point in the center line of South Main Street and in the East line of said quarter section, South 6 deg. West, a distance of 545 feet from the Northeast corner of said quarter section; thence South 6 deg. West, along said road centerline and East line of said quarter section, a distance of 85 feet to a point; thence North 84 deg. West, parallel with the North line of Grantors land, a distance of 400 feet to a point; thence North 6 deg. East parallel with the center line of said road a distance of 86 feet to a point in the North line of Grantors land a distance of 400 feet the true place of beginning and contains .7804 acres of land, more or less.

And known as being a part of the Northeast quarter of Section No. 25, bounded and described as follows:

Commencing at a point in the center line of South Main Street Extension and in the East line of said quarter section, South 6 deg. West, a distance of 630 feet from the Northeast corner of said quarter section; thence North 84 deg. West, a distance of 400 feet the true place of beginning for the parcel of land herein described; thence continuing North 84 deg. West, a distance of 71.30 feet to a point; thence North 6 deg. East, a distance of 85 feet to a point; thence South 84 deg. East, a distance of 71.30 feet to a point; thence South 6 deg. West, 85 feet the true place of beginning.

Situated in the City of New Franklin, County of Summit and State of Ohio:

And known as being a parcel of land situated in the Northeast quarter of Section 25, New Franklin Village, County of Summit and being further described as follows:

Beginning at a P.K. nail at the Northeast corner of Section 25; thence South 6 deg. 00 minutes West, along the East line of said section, a distance of 630 feet to a point which is the true place of beginning; thence continuing South 6 deg. 00 minutes West, a distance of 10.00 feet to a point; thence North 84 deg. 00 minutes West, passing through a 5/8 inch diameter iron pin set at 30 feet, a distance of 471.30 feet to a 5/8 inch diameter iron pin set; thence North 6 deg. 00 minutes East, a distance of 10.00 feet to a point; thence South 84 deg. 00 minutes East, a distance of 471.30 feet the true place of beginning and containing 0.108 acres. Surveyed by Lowell A. Young, R. S. June 1882.

Property located at: 5590 S. Main Street, Akron, OH 44319.

Property appraised at: One Hundred Five Thousand Dollars ($105,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 14th day of April, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
