By virtue of an Order of Sale No. CV2016 08 3579 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 14TH DAY

OF APRIL, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Lot 3, Tract 8, formerly Portage Township and more particularly described as follows:

Beginning at a point in the Southerly line of East Exchange Street about 218 feet Easterly from the intersection of said street line with the Easterly line of Lot No. 92 of the Vandalia Heights Allotment, as recorded in Plat Book 20, Page 27, Summit County Records; thence Southerly along the Easterly line of land conveyed to Charles E. Akers by deed recorded in Volume 299, Page 208, Summit County Records 165 feet; thence Easterly, parallel with the South line of East Exchange Street, 46 feet to a point; thence Northerly along the West line of land formerly owned by William Lutz 165 feet to the Southerly line of East Exchange Street; thence Westerly along the Southerly line of East Exchange Street 46 feet to the place of beginning and being the East 46 feet of land conveyed to the Grantor herein, John A. Koontz, by deed recorded in Volume 297, Page 524 of Summit County Records, less the portion thereof conveyed to the City of Akron, Ohio for the widening of East Exchange Street, be the same more or less.

Property located at: 828 E. Exchange Street, Akron, OH 44306.

Property appraised at: Seventy-two Thousand Dollars ($72,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 28th day of April, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
