at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:
And known as being part of Lot 40 in the Perkins Park Sub-division the plat of which is recorded in the Recorder's Office of Summit County, Ohio in Plat Book 19, Pages 32 to 35 and bounded and described as follows:
Beginning in the Northerly line of said Lot 40 which is also the Southerly line of Noah Avenue, nine (9) feet Easterly of the Northwesterly corner of said Lot 40; thence Easterly along the arc of a curve deflecting to the right, the radius of which is 392.77 feet, which is also the Southerly line of Noah Avenue, 76.47 feet to a point of compound curve; thence Southerly along the arc of a curve deflecting to the right the radius of which is 20 feet; 31.42 feet to a point of tangency in the Southeasterly line of said Lot 40, which is also the Northwesterly line of Diagonal Road; thence Southwesterly along Southeasterly line of said lot 47.50 feet to the most Southerly corner of said Lot 40; thence Northwesterly along the Southwesterly line of said Lot 40, 82.70 feet; thence Northeasterly parallel to the Westerly line of said Lot 40, 61.48 feet to the place of beginning.

Property located at: 822 Noah Ave., Akron, OH 44320.
Property appraised at: Forty-five Thousand Dollars ($45,000.00). Property cannot be sold for less than 2/3 of the appraised value.
TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.
AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 5th day of May, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))
The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
