By virtue of an Order of Sale No. CV2016 09 4118 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 14TH DAY

OF APRIL, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Norton, County of Summit and State of Ohio:

And known as being a part of Lot Number 10, of the Norton Township and originally intended to be known as Lot Number 13, in the unrecorded Wintergreen Ledges Number Two Allotment as surveyed by C. L. Bushner, Registered Surveyor and presently or formerly recorded in the names of Bonny Cyphers and Joseph Wilson, Trustees, Reception Number 54034395, Summit County Recorder's Records and more fully described as follows:

The true place of beginning for the parcel of land herein described being a mag nail set at the center line intersection of the center line of Warren Avenue, TR 307 (a street 50 feet in width) with the center line of Anton Street (a street 50 feet in width) as referenced in dedication Plat Book 107, Page 70 of said Summit County Records, note a 1" pinched top iron pipe was found and used for line and distance at the intersection of the Easterly right of way line of said Warren Avenue and the Northerly right of way line of Anton Street, said pipe was found to be 25.00 feet off the center line of Warren Avenue and 24.96 feet off the center line of Anton Street; thence Northerly along the center line of said Warren Avenue N. 02 deg. 52' 00" E., (deed bearing used for calculations of angles) 144.758 feet to a mag nail set; thence Easterly S. 87 deg. 05' 03" E., 280.00 feet to a 5/8 inch steel bar set with cap (Lambacher 5435) and passing over a 1 inch iron pipe found on the Easterly right of way line of said Warren Avenue, S. 87 deg. 05' 03" E., 25.00 feet from said center line point; thence Southerly and parallel with the center line of said Warren Avenue S. 02 deg. 52' 00" W., 144.704 feet to a 5/8 inch steel bar set with cap (Lambacher 5434) on the center line of said Anton Street and passing over a 5/8 inch steel bar set on the Northerly right of way line of said Anton Street, N. 02 deg. 52' 00" E., 24.911 feet from said center line point described; thence Westerly along the center line of said Anton Street N. 87 deg. 05' 43" W., 280.00 feet to the center line intersection of said Anton Street and Warren Avenue and the true place of beginning for the parcel of land herein described and containing 0.9303, acre of land and reserving 25.00 feet along the Southerly and Westerly sides of the above described parcel for roadway purposes.

Property located at: 2089 Warren Avenue, Akron, OH 44320.

Property appraised at: Fifty-one Thousand Dollars ($51,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 28th day of April, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
