By virtue of an Order of Sale No. CV2016 04 1853 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 7TH DAY

OF APRIL, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Green, County of Summit and State of Ohio:

And being a part of the Southeast quarter of Section 7, formerly Green Township and further known as being part of a tract of land conveyed to Scott and Jennifer Rice as recorded in Reception No. 54982020 of the Summit County Recorder's Office, described as follows:

Beginning at the Southeast corner of Southeast quarter of said Section 7 in the centerline of Cottage Grove Road (CH 226, a 60 foot public right of way) witnessed by a 1/2 inch pipe found on the South line of said Section 7 North 87 deg. 56' 57" West at a distance of 1310.52 feet; thence North 01 deg. 26' 00" East along the Easterly line of said Section 7 and the centerline of said Cottage Grove Road, a distance of I 034.55 feet to the true place of beginning; thence South 87 deg. 17' 22" West, a distance of 122.28 feet to a 5/8 inch capped rebar set at an angle point, passing through a 5/8 inch capped rebar set on the Westerly right of way line of said Cottage Grove Road at a distance of 30.08 feet; thence North 88 deg. 01' 12" West, a distance of 248.73 feet to a 5/8 inch capped rebar set in the Easterly line of land conveyed to Virgil G. and Bonnie L. White as recorded in Reception No. 55075571; thence North 01 deg. 26' 00" East along said White and land conveyed to Michael R. Fiehn as recorded in Reception No. 54314768, a distance of 120.00 fleet to a 5/8 inch capped rebar set; thence South 88 deg. 01' 12" East along a Southerly line of said Fiehn, a distance of 370.70 feet to a point in the East line of said Section 7 and the centerline of said Cottage Grove Road, passing through a 5/8 inch capped rebar set on the Westerly right of way line of said Cottage Grove Road at a distance of 340.70 feet; thence South 01 deg. 26' 00" West along the Easterly line of said Section 7 and the centerline of said Cottage Grove Road, a distance of 110.00 feet to the true place of beginning. The above described tract of land contains 1.0055 acres of land of which 0.0766 acres lie within the right of way limits of said Cottage Grove Road, as surveyed by Timothy J. Briggs, P.S. 7495, Campbell & Associates, Inc., of Cuyahoga Falls, Ohio in September 2004, and Jim Yurkshatt of Campbell & Associates, Inc. in 1994. The basis of bearings for the above description is North 01 deg. 26' 00" East, as the East line of said Section 7 and the centerline of Cottage Grove Road, be the same more or less, but subject to all legal highways.

Property located at: 4052 Cottage Grove Road, Uniontown, OH 44685.

Property appraised at: Two Hundred Fifty-two Thousand Dollars ($252,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 21st day of April, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
