By virtue of an Order of Sale No. CV2015 05 2642 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 28TH DAY

OF APRIL, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Green, County of Summit and State of Ohio:

And known as being a part of Fractional Section #2 in said city and more fully described as follows:

Beginning at an iron pipe on the Easterly line of said Fractional Section #2 which point bears South 06 deg. 00' West, a distance of 1572.55 feet from an iron pipe marking the Northeasterly corner of said fractional section; thence South 06 deg. 00' West along the Easterly line of said Fractional Section #2, a distance of 437.92 feet to a marked stone monument; thence 83 deg. 38' West, a distance of 858.00 feet to a point within the right of way of Long Road (R.R. #243) and passing over a lead filled iron pipe monument marking the Easterly line of Long Road (a 50.00 feet wide street) and found to be a distance of 29.70 feet from the end point of said course; thence North 06 deg. East and parallel to the Easterly line of said Fractional Section #2, but not parallel to Long Road, a distance of 125.00 feet to a point; thence South 83 deg. 53' East, a distance of 229.95 feet to a point; thence North 06 deg. 07' East along the East line of lands previously conveyed by instruments recorded in Volume 4816, Page 310, Volume 4910, Page 225, and Volume 4910, Page 257 respectively, a distance of 448.66 feet to a point in the South line of subdivision known as Pressler Heights as recorded in Plat Book 56, Page 67, of the Summit County Record of Plats, which point bears South 71 deg. 21' East, a distance of 183.65 feet from the Easterly line of Long Road; thence South 71 deg. 21' East, a distance of 642.72 feet to the place of beginning and containing an area of approximately 7.9589 acres of land.

Property appraised at: One Hundred Twenty-nine Thousand Dollars ($129,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 12th day of May, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
