By virtue of an Order of Sale No. CV2016 10 4411 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 28TH DAY

OF APRIL, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Springfield, County of Summit and State of Ohio and known as being a part of Tract No. 5 of said township and more fully described as follows:

Beginning at a point in the East line of said Tract No. 5 which is North 3 deg. 30' East along said tract line 25 feet from an iron pipe at the Northwest corner of Lot No. 90 of Sawyers 4th Springfield Lake Allotment as recorded in Plat Book 16, Page 13 of Summit County Records; thence North 86 deg. 23' West along the center line of Mingo Avenue, 110 feet to the center line of the proposed 45 foot street; thence South 3 deg. 30' West along said center line 325 feet to the true place of beginning for this parcel; thence South 3 deg. 30' West along said center line 50 feet; thence North 86 deg. 23' West parallel with the center line of Mingo Avenue 110 feet to an iron pipe; thence North 3 deg. 30' East, 50 feet to an iron pipe; thence South 86 deg. 23' East parallel with the center line of Mingo Avenue, 110 feet to the true place of beginning. Containing as surveyed August 24, 1943 by S. W. Swigart & Son, 0.1263 of an acre of land. Iron pipes are also set at the intersections of the North and South line of the above described lot with the West line of said proposed 45 foot street being North 86 deg. 23' West, 22.5 feet from the Northeast and Southeast corners thereof.

Property appraised at: Forty-eight Thousand Dollars ($48,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 12th day of May, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
