By virtue of an Order of Sale No. CV2016 07 2922 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 5TH DAY

OF MAY, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

Known as being all of Lots No. 6 and 8 in the Brodt Allotment, as recorded in Plat Book 8, Page 26 of the Summit County Records of Plats, further bounded and described as follows:

Commencing at a #4 rebar and I.D. cap #6541 set flush this survey at the Northwest corner of Lot No. 6;

Course 1: Thence North 89 deg. 19 min. 04 sec. East, along the North line of Lot No. 6, a distance of 150.71 feet to a spike and I.D. cap #6541 set this survey in the side of a tree stump;

Course 2: Thence South 04 deg. 09 min. 47 sec. East, along the East line of Lots No. 6 and 8, a distance of 90.00 feet to a #4 rebar and I.D. cap #6541 set flush this survey;

Course 3: Thence South 89 deg. 19 min. 04 sec. West, along the South line of Lot No. 8, a distance of 150.71 feet to a #4 rebar and I.D. cap #6541 set flush this survey in the East line of Second Street S.W., 45 feet wide;

Course 4: Thence North 04 deg. 09 min. 47 sec. West, along the East line of said Second Street S.W., a distance of 90.00 feet to the true place of beginning and containing 13,539 S.F. or 0.3108 acres of land, but subject to all legal rights, easements and restrictions of record, as surveyed in August 2000, by John W. Patrick, Jr., Professional Land Survey #6541.

The S.P.C. Grid Bearing of North 89 deg. 40 min. 24 sec. East, along the centerline of Harvey Street, as calculated from the City of Akron's Horizontal Control Plans was used as the "Basis of Bearings" for this legal description.

Deed Reference Number: Dated December 17, 2013, filed December 23, 2013, recorded as Instrument Number 56017363, Summit County, Ohio records.

Property located at: 1895 2nd Street NW and 1901 2nd Street SW, Akron, OH 44314.

Property appraised at: Sixty-nine Thousand Dollars ($69,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 19th day of May, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
