By virtue of an Order of Sale No. CV2016 10 4445 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 28TH DAY

OF APRIL, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Munroe Falls, County of Summit and State of Ohio:

And known as being a part of Lot No. 4, Tract 2 of Original Tallmadge Township in said village, bounded and described as follows:

Beginning at point in the center line of a proposed 50.00 foot street known as Highland Avenue, said beginning point may be found as follows:

Commencing at a point in the West line of the Tallmadge-Stow Corners Road, 3.00 feet East from the Southeast corner of said Lot No. 2; thence North 1 degree 40' East along the West line of said Tallmadge-Stow Corners Road, 382.80 feet to the intersection of the West line of the Tallmadge-Stow Corners Road with the center line of a proposed 60 feet street known as Northmoreland Avenue; thence North 88 degrees 52' West along the center line of said Northmoreland Avenue, 1,837.55 feet; thence South 1 degree 08' West, 682.50 feet to the center line of said Highland Avenue; thence North 88 degrees 52' West along the center line of said Highland Avenue, 978.50 feet to the true point of beginning; thence North 88 degrees 52' West, still along the center line of said Highland Avenue, 109.995 feet to a point in the Star line; thence South 0 degrees 20' West along the Star line, 341.02 feet to a point; thence South 88 degrees 26' East, 107.735 feet to a point; thence North 1 degree 08' East, 341.712 feet to the place of beginning. Reserving from the above described premises, a strip of land, 25.0 feet in width, off the North end for the use of the general public for street purposes.

Property appraised at: One Hundred Seventy-four Thousand Dollars ($174,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 12th day of May, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
