By virtue of an Order of Sale No. CV2016 07 3188 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 5TH DAY

OF MAY, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the County of Summit, in the State of Ohio and in the City of Akron, and bounded and described as follows:

And known as being a part of Original Tract Number Eleven (11), formerly Coventry Township, further bounded and described as follows, to-wit:

Beginning at a point in the North line of said Original Tract Number Eleven (11) and the center line of Jonathan Avenue as shown on the recorded plat of Wilbeth-Arlington No. 2, as recorded in Plat Book 29, Pages 40 to 46 of Summit County Records, which point is S. 86 deg. 37' 00" West, a distance of 2116.13 feet from the Northeast corner of said Original Tract Number Eleven; thence S. 2 deg. 0' 0" E. parallel to the East line of said Original Tract Number Eleven, a distance of 550.00 feet to a point; thence S. 86 deg. 37' 0" West, parallel to the North line of said Original Tract Eleven, a distance of 80.02 feet to a point; thence N. 2 deg. 0' 0" West, parallel to the East line of said Original Tract Number Eleven, a distance of 550.00 feet to a point in the North line of said Original Tract Eleven and the center line of said Jonathan Avenue; thence N. 86 deg. 37' 0" E. along the North line of said Original Tract Number Eleven and the center line of said Jonathan Avenue, a distance of 80.02 feet to the place of beginning. Reserving the North 25 feet of the above described land for street purposes, the same to form a part of the South half of proposed Jonathan Avenue. This description is intended to cover Lot No. 6 of an unrecorded plat of Arlington-Waterloo Acres.

Property appraised at: Ninety-three Thousand Dollars ($93,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 19th day of May, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
