By virtue of an Order of Sale No. CV2014 11 4958 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 19TH DAY

OF MAY, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Located in the State of Ohio, County of Summit, Township of Richfield and being known as part of Lot 6, Tract 5 in said township and being further described as follows:

Beginning at a 3/8" pinched top pipe found at the Northeast corner of Lot 5, Tract 5; thence along the North line of Lot 5, South 88 degrees 50' 25" West, a distance of 1255.06 feet to a 5/8" capped "Jensen" pin found at the P.I. of Boston Mills Road (60' wide); thence continuing along the centerline of Boston Mills Road (60' wide) and the North line of Lot 5, South 88 deg. 35' 41" West, a distance of 327.40 feet to a point in the centerline of Boston Mills Road (60' wide) and the North line of Lot 6; said point being the Northwest corner of land conveyed to A. Mascia by Deed Volume 5768, Page 836 of the Summit County Recorder's Office; said point being witnessed by a 1/2" pin found at North 32 degrees 19' 15" East, a distance of 1.61 feet; and said point also being the true place of beginning of the parcel herein to be described; thence along the West line of the aforementioned A. Mascia property South 00 degrees 10' 25" West, a distance of 628.94 feet to a Bock & Clark capped 5/8" rebar set in the North line of land conveyed to L. Adams & A. Defratis by Official Record Volume 97, Page 275 of the Summit County Recorder's Office, said point also being the Southwest corner of the aforementioned A. Mascia property; thence along the North line of the aforementioned L. Adams & A. Defratis property South 88 degrees 54' 23" West, a distance of 291.10 feet to a Bock & Clark capped 5/8" rebar set (a "Jensen capped pin was found South 88 degrees 54' 23" West at 265.10 feet); thence North 02 degrees 42' 47" East, a distance of 598.67 feet to a Bock & Clark capped rebar found; thence North 00 degrees 37' 38" West, a distance of 30.00 feet to a railroad spike set in the North line of the aforementioned Lot 6 and centerline of Boston Mills Road; thence along the North line of the aforementioned Lot 6 and the centerline of Boston Mills Road (60' wide) North 88 degrees 35' 41" East, a distance of 265.04 feet to the true place of beginning and containing within said bounds 3.997 acres of land, more or less, and subject to all legal highways. As surveyed by Kevin J. Clark P.E./P.S. Professional Surveyor No. 6498 on April 28, 1994 under Bock & Clark Project No. 95148. The basis of bearings for this description in North 88 deg. 35' 41" East as the centerline of Boston Mills Road, according to a survey by James E. Moyer, Professional Surveyor No. 7368, in January of 1991 under Bock & Clerk Project No. 91724.

Deed Reference Number: Dated February 27, 1998, filed March 2, 1998, recorded as Instrument Number 54110474, Summit County, Ohio records.

Property located at: 2950 Boston Mills Road, Richfield, OH 44286.

Property appraised at: Four Hundred Fourteen Thousand Dollars ($414,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 2nd day of June, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
