By virtue of an Order of Sale No. CV2016 10 4377 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 19TH DAY

OF MAY, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

The land referred to in this commitment is described as follows:

Situated in the City of Akron, County of Summit and State of Ohio and known as being part of Lot 16, Tract 10, formerly Coventry Township, also known as being part of a parcel conveyed to Holy Trinity Evangelical Lutheran Church of Firestone Park as recorded in O.R. 1933, Page 548, and being more fully bounded and described as follows:

Beginning at a lead center monument found at a point of curvature in the Northerly right-of-way line of Clinton Avenue (45 feet R/W) (dedicated P.B. 57, Page 70), which monument is located South 89 deg. 56' 00" West, 57.84 feet from the Southwest corner of Lot 456 in the Beverly Park Allotment as recorded in P.B. 24, Page 77; thence, Southwesterly along the North line of said Clinton Avenue following the arc of a circular curve to the left, said curve having a radius of 545.50 feet, a central angle of 1 deg. 29' 17", a chord of 14.17 feet which bears South 89 deg. 11' 22" West, an arc distance of 14.17 feet, to the Southwest corner of a parcel conveyed to D. Jr. and L. A. Gunnoe (O.R. 1525, Page 360) and being the true place of beginning for the parcel hereinafter described (witness a 1/4 inch pinch top pipe 0.39 feet North); thence continuing, Southwesterly along the North line of said Clinton Avenue following the arc of a circular curve to the left, said curve having a radius of 545.50 feet, a central angle of 8 deg. 27' 19", a chord of 80.43 feet which bears South 84 deg. 13' 04" West, an arc distance of 80.50 feet, to a point (witness a 1/4 inch pinch top pipe found 0.64 feet North); thence North 00 deg. 46' 56" East, 118.19 feet to a 5/8 inch rebar w/cap No. 4883 found at the Southwest corner of a parcel conveyed to R. and M. Deberry (D.V. 5809, Page 689); thence North 89 deg. 56' 00" East, 80.23 feet along the South line of said Deberry Parcel to the Southeasterly corner thereof (witness a 1/4 inch pinch top pipe found 0.14 feet South); thence South 00 deg. 57' 02" West, 110.18 feet, along the Westerly line of the aforementioned Gunnoe Parcel, to the true place of beginning and containing 0.208 acres more, or less, as determined by a survey made under the direction of Stephen P. Campbell, P.L.S. 7330 of Campbell and Associates Inc. in December 1998. The bearings used to prepare this description are based on North 89 deg. 56' 00" East as the bearing of Wayne Avenue as recorded in O.R. 1955, Page 1273. Be the same more or less, but subject to all legal highways.

Property appraised at: One Hundred Forty-two Thousand Dollars ($142,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 2nd day of June, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
