By virtue of an Order of Sale No. CV2016 08 3518 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 19TH DAY

OF MAY, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

PARCEL NO. 1:

Situated in the Township of Northhampton, now known as City of Cuyahoga Falls, County of Summit and State of Ohio:

And beginning at a stone in the Northwest corner of parcel of land conveyed to Pearl B. Schultz deed recorded in Volume 908, Page 692, Summit County Records, which stone may be found as follows:

Beginning at the Northeast corner of Lot No. 48; thence Westerly along the North line of Lot No. 48, about 1247.99 feet to a point; thence Southeasterly about 1269.0 feet to a point which is 1095.60 feet Westerly from the East line of Lot No. 48 measuring from this stone Easterly along the North line of parcel of land conveyed to Pearl B. Schultz 275 feet to a point, using this as a point of beginning and being a part of Lot No. 48 in said township and bounded as follows:

Beginning at this point and extending to a Southerly direction along a line that forms a 90 deg. angle where it leaves the North boundary line of Pearl B. Schultz and J. Elmer Schultz land to the center of Mud Brook at low water mark, a distance of about 135 feet; thence following the center of Mud Brook at low water mark to a point in the North boundary of Pearl B. Schultz and Elmer Schultz land where the center line of Mud Brook at low water mark crosses the North boundary line of Pearl B. Schultz and J. Elmer Schultz land about 617 feet; thence Westerly along said North boundary line to the point of beginning about 605 feet forming right angle triangle piece of land.

Beginning at a stone in the East line of said Lot No. 48 at the Southeast corner of a parcel of land conveyed to Lemuel Leach by deed recorded in Volume 309, Page 155, Summit County Records; thence 89 deg. West along the South line of said parcel, a distance of 1005.6 feet to a stone which point may be found as follows:

Beginning at the Northeast corner of Lot No. 48; thence Westerly along the North line of Lot No. 48 about 1247.99 feet to a point; thence Southeasterly about 1269.0 feet to a point, which is 1095.60 feet, Westerly from the East line of Lot No. 48; thence North 6 deg. 45' West 316.0 feet; thence South 78 deg. 25' East, 1155.0 feet to the East line of said Lot No. 48; thence South 0 deg. 25' East, 100 feet along the lot line and road center to the place of beginning.

PARCEL NO. 3:

Situated in the Township of Northampton, now known as the City of Cuyahoga Falls, County of Summit and State of Ohio:

And known as being a part of Lot No. 48 in said township bounded and described as follows:

Beginning at a point in the East line of said Lot No. 48, 1246.74 feet South of the Northeast corner of said lot, said beginning point being the Southeast corner of land owned by E. R. and V. K. Burrell; thence South along said East line 25 feet to a point; thence North 89 deg. 21' West parallel to the South line of said E. R. and V. K. Burrell 215.60 feet to a point; thence North parallel to said East line, 25 feet to said South line; thence South 89 deg. 21' East, 215.60 feet to the point of beginning, excepting from the above 25 foot strip all that part East of the center line of County Highway 27.

Property located at: 2140 Northampton, Cuyahoga Falls, OH 44223.

Property appraised at: Three Hundred Thirty-nine Thousand Dollars ($339,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 2nd day of June, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
