By virtue of an Order of Sale No. CV2010 08 5526 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Lot Number Nine (9), Tract Number Ten (10), formerly in Coventry Township, and more particularly described as follows:

Beginning at a point in the Southerly line of Wilbeth Road, (said road at the present time is sixty (60 feet wide), which point is 149.94 feet Westerly of and 60 feet Southerly of a monument at the Northeast corner of Girard Street and Wilbeth Road; thence Westerly along the Southerly line of Wilbeth Road 110 feet to a point; (which point is the Southeast corner of an unnamed street and Wilbeth Road); thence Southerly along the Easterly line of the unnamed street 243 feet to a point; thence Easterly 110 feet to a point; thence Northerly 243 feet to the point of beginning and containing 0.6136 acres of land, more or less.

Commencing at the intersection of the Westerly right of way line of Girard Street and the Northerly right of way line of Palmetto Avenue; thence Northerly along the Westerly right of way line of Girard Street approximately 166.62 feet to the Southerly property line of land now owned by Grantee; thence Westerly along the Southerly property line of Grantee's property for a distance of approximately 209.85 feet to the Easterly right of way line of Ireland Avenue; thence Southerly along the Easterly right of way line of Ireland Avenue approximately 166.62 feet to the Northerly right of way of Palmetto Avenue; thence Easterly along the Northerly right of way line of Palmetto Avenue approximately 209.85 feet to the point of beginning.

Beginning at an iron pipe in the South line of East Wilbeth Road (60 feet wide) at its intersection with the West line of Girard Street (50 feet wide); thence North 89 deg. 28' 30" West, along the South line of East Wilbeth Road, 99.85 feet to an iron pipe in the East line of land conveyed to the Parish of St. Peter's Episcopal Church as recorded in Volume 3498, Page 405, Summit County Records of Deeds; thence South 0 deg. 26' 30" West along the East line of said church property, 243.00 feet to the Southeast corner thereof; thence South 89 deg. 28' 30" East, 99.85 feet to an iron pipe in the West line of Girard Street; thence North 0 deg. 26' 30" East along the West line of Girard Street, 243.00 feet to the place of beginning and containing as surveyed in June 1960 by S. G. Swigart and Son, 0.5570 of an acre of land.

Beginning for a description of the parcel herein to be conveyed at an iron pin found monumenting the intersection of the South right-of-way line of Wilbeth Road (said iron pin being South 40.00 feet from the centerline of Wilbeth Road); with the West right-of-way line of Girard Street (50 feet wide); thence with the West line of said Girard Street South 183.00 feet to an iron pin set; thence traversing lands presently in the name of Parish of St. Peters Episcopal Church, Inc. the following:

West 82.00 feet to an iron pin set; North 183.00 feet to an iron pin set in the South right-of-way line of said Wilbeth Road; thence with said South line East 82.00 feet to the true place of beginning. Containing 0.3445 acres of land, be the same more or less, but subject to all legal highways, easements and limitations of record, if any, as surveyed and determined from local records and monumentation in June 1993 by Douglas E. Bedore, Registered Surveyor 6023.

Property located at: 270 E. Wilbeth Road, V/L Palmetto Avenue and V/L Girard Road, Akron, OH 44301.

Property appraised at: Three Hundred Thirty Thousand Dollars ($330,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 2nd day of June, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
