By virtue of an Order of Sale No. CV2016 07 2929 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 23RD DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

And known as being in Tract No. Eleven (11) and bounded and described as follows:

Commencing at a stone in the centerline intersection of Glenmount Avenue and the Swartz Road and thence along the centerline of Swartz Road South 60 deg. East, 665 feet to a point in the center line of a proposed 50 foot road to be known as Penelope Avenue; thence along the centerline of a proposed 50 foot road to be known as Penelope Avenue (now known as Penguin Avenue) North 30 deg. East 174.07 feet to an angle in said Penelope Avenue; thence along the centerline of Penelope Avenue North 0 deg. 20' 30" East, a distance of 443.38 feet to the true place of beginning for property herein described; thence North 89 deg. 39' 30" West, a distance of 234.04 feet to a point; thence North 9 deg. 27' East, a distance of 50.64 feet to an angle point; thence North 0 deg. 20' 30" East, a distance of 30.00 feet to a point; thence South 89 deg. 39' 30" East, a distance of 226.04 feet to a point in the centerline of Penelope Avenue; thence South 0 deg. 20' 30" West along the centerline of Penelope Avenue, a distance of 80.00 feet to a place of beginning and containing 0.419 of an acre of land, be the same more or less.

Property located at: 2166 & 2172 Penguin Avenue, Akron, OH 44319.

Property appraised at: Two Hundred Twenty-five Thousand Dollars ($225,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 7th day of July, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
