By virtue of an Order of Sale No. CV2016 10 4369 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 23RD DAY

OF JUNE, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio and known as being a part of Original Lot 1, Tract 2, formerly Coventry Township and more fully described as follows:

Beginning at the intersection of the North line of O.L. 1 and the West line of Tyler Street as shown on the plat of Westwood Allotment as recorded in Plat Book 38, Page 33 of the Summit County Record of Plats, said beginning point being also N. 89 deg. 11 min. 10 sec. W., 129.12 feet along said lot line from the Northwest corner of the Bellevue Allotment as recorded in Plat Book 15, Page 12; thence N. 89 deg. 11 min. 10 sec. W., along the North line of O.L. 1, a distance of 72.50 feet to an iron pin set at the true place of beginning of the parcel herein described; thence S. 05 deg. 30 min. 00 sec. E., a distance of 128.88 feet to an iron pin set on the North line of Russell Avenue; thence Southwesterly, along the North line of Russell Avenue, following the arc of a curve to the left, having a central angle of 03 deg. 19 min. 45 sec., a radius of 1271.25 feet, a chord length of 73.86 feet, a chord bearing of S. 81 deg. 00 min. 41.5 sec. W., an arc distance of 73.87 feet to an iron pin set; thence N. 09 deg. 48 min. 49 sec. W., a distance of 143.13 feet to an iron pin set on the North line of O.L. 1; thence S. 89 deg. 11 min. 10 sec. E., along the North line of O.L. 1, a distance of 85.00 feet to the place of beginning and containing 0.2457 acre of land as surveyed in November 1991 by Robert C. Winebrenner, Registered Surveyor, but subject to all legal highways and any easements or restrictions of record.

Property appraised at: Seventy-five Thousand Dollars ($75,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 7th day of July, 2017. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
