By virtue of an Order of Sale No. CV2016 02 1021 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 30TH DAY

OF JUNE, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

The following described property situated in the City of Akron, County of Summit and State of Ohio:

And known as being a part of Lot Number Ninety (90), Ely Lots, as surveyed and numbered by Dwight Newton, Surveyor and recorded in Plat Book One (1), Page Twenty-six (26), Recorder's Office, Summit County, Ohio, and more particularly described as follows, beginning at a point in the centerline of Aqueduct Street at the Southwest corner of said Lot Number Ninety (90); thence North 39 deg. West along the Westerly line of said lot and along the centerline of Aqueduct Street, a distance of 84.72 feet to the true place of beginning; thence North 51 deg. East, a distance of 94 feet to a point; thence South 39 deg. East, a distance of 11.70 feet to a point; thence North 68 deg. 06' East, a distance of 104.84 feet to a point; thence North 21 deg. 54' West, a distance of 40.10 feet to a point; thence South 68 deg. 06' West, a distance of 117.50 feet to a point; thence North 39 West, a distance of 10.70 feet to a point; thence South 51 West, a distance of 94 feet to a point in the Westerly line of said Lot Number Ninety (90) and in the center line of Aqueduct Street; thence South 39 East, a distance of forty-one feet to the place of beginning.

Excepting therefrom the following: Situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Lot Number 90, Ely Lots, as surveyed and numbered by Dwight Newton, Surveyor, as recorded in Plat Book 1, Page 26 of Summit County Record of Plats, and more fully described as follows:

Beginning at a point in the centerline of Aqueduct Street as the Southwest corner of said Lot Number 90; thence N. 39 deg. 00' W. along the Westerly line of said lot and along the centerline of Aqueduct Street, 84.72 feet to a point; thence S. 51 deg. 00' E., (passing through an iron pipe 30.00 feet from said centerline), 94.00 feet to a drill hole and the true place of beginning; thence N. 73 deg. 59' 48" E., 108.86 feet to an iron pipe; thence S. 68 deg. 06' W., 104.84 feet to a drill hole; thence N. 39 deg. 00' W., 11.70 feet to the true place of beginning as surveyed by Charles J. Pennore, Registered Surveyor, in June, 1993.

Property located at: 387 Aqueduct Street, Akron, OH 44303.

Property appraised at: Fifty-seven Thousand Dollars ($57,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 14th day of July, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
