By virtue of an Order of Sale No. CV2016 08 3306 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 23RD DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Original Lot 7, Tract 2, Coventry Township and more particularly described as follows:

Beginning at the Northeast point of intersection of Battles Avenue and East Avenue; thence 200 feet Northeasterly along the East line of East Avenue; thence at right angles (South 60 deg. 15' 11" East) Southeasterly 103.87 feet to a point the West line of Prentiss Park; thence South 1 deg. 34' 19" W., along the West line of Prentiss Park 127.26 feet to a point in the North line of Battles Avenue; thence along the North line of Battles Avenue 186 feet to the point of beginning. Containing 0.5101 acres of ground more or less, and excluding from the above described property the 10 feet wide strip along Battles Avenue, and the property beyond the curve at the street corner, taken by the City of Akron for street widening as recorded in Volume 5025, Page 596, together with all appurtenances thereto, and all right, title and interest of seller in and to all roads, streets, and ways, whether public or private, bounding said premises, and all buildings, and all buildings and improvements thereon. Commencing at a mag nail set at the centerline intersection of East Avenue 60 feet and Battles Avenue 50 feet said point having Ohio State Plane Coordinates (NAD 83 North Zone) North 504, 128.584; E. 2,224,917.481; thence Northeasterly with the centerline of East Avenue North 27 deg. 53' 50" East, 97.58 feet to a point; thence Southeasterly South 62 deg. 06' 10" East, 30.00 feet to a point on the Easterly right of way of East Avenue and the true place of beginning of the easement herein described; thence Southeasterly along the arc of a curve to the left (central angle 118 deg. 12' 24", radius = 25.00 feet, tangent = 41.78 feet, length = 51.58 feet, chord = 42.90 feet, chord bearing = South 31 deg. 12' 21" East), 51.58 feet to a point at the Northerly line of Battles Avenue described in a deed to the City of Akron in Summit County Deed Records Volume 5025, Page 596; thence Westerly with the Northerly line of Battles Avenue, South 89 deg. 41' 28" West, 25.04 feet to a point; thence continuing with said City of Akron parcel Northeasterly along the arc of a curve to the right (central angle 118 deg. 12' 24", radius = 10.00 feet, tangent = 16.71 feet, length = 20.63 feet, chord = 17.16 feet, chord bearing = North 31 deg. 18' 01" West), 20.63 feet to a point; thence Northeasterly with the Easterly line of East Avenue North 27 deg. 53' 50" East, 25.07 feet to a point and the true place of beginning for the land herein described. Containing 336 square feet (0.0077 acres) more or less and subject to all easements, restrictions and right of ways of previous record. Bearings in the description are Grid Bearing NAD 1983. The description is based on a survey done in May of 2004 by Jeffrey Caston, Professional Surveyor.

Property appraised at: One Hundred Twenty-six Thousand Dollars ($126,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 7th day of July, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
