at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and in the State of Ohio:
And known as being part of Lot Number Six (6), Tract Nine (9) formerly Tallmadge Township and described as follows:
Beginning at an iron pipe at the Northwest corner of Eastland Allotment Number Five (5) as recorded in Plat Book 22, Page 70, Summit County Records; thence North 3 degrees 40' East, 1045.46 feet to an iron pipe at the Northwest corner of the Sparhawk Allotment proposed, which point is also the Southerly line of the Erie Railroad right of way; thence North 77 degrees 30' 40" East along the Southerly line of the Erie Railroad right of way 658.64 feet to the true place of beginning, continuing North 77 degrees 30' 40" East, 50 feet to a point; thence South 12 degrees 29' 20" East, 200 feet to the North line of Sparhawk Avenue proposed; thence South 77 degrees 30' 40" West, 50 feet to a point; thence North 12 degrees 29' 20" West, 200 feet to the true place of beginning, known as Sub Twenty-three (23) Sparhawk unrecorded. Be the same more or less, but subject to all legal highways.

Property appraised at: Fifty-seven Thousand Dollars ($57,000.00). Property cannot be sold for less than 2/3 of the appraised value.
TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.
AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 21st day of July, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))
The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
