By virtue of an Order of Sale No. CV2017 02 0718 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 7TH DAY

OF JULY, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

The following described premises, situated in the City of Stow, County of Summit and State of Ohio:

And known as being a part of Original Lot No. 89 of Stow Township and further bounded and described as follows:

Beginning at the centerline intersection of Stow Road (C.H. 106) and Norton Road (C.H. 120), which is also on the North line of Original Lot No. 89 of Stow Township; then South 86 degrees 00 minutes 00 seconds East, 1089.46 feet along the centerline of Norton Road to the true place of beginning for the following described parcel of land; thence continue South 86 degrees 00 minutes 00 seconds East 92.74 feet along centerline of Norton Road to a railroad spike found at the Northwest corner of the Heritage Heights Part 1 Allotment (Vol. 116, Pages 44-45); thence South 03 degrees 47 minutes 03 seconds West, 344.70 feet along the Westerly line of the Heritage Heights Part 1 Allotment to an iron pin set; thence North 86 degrees 00 minutes 00 seconds West, 94.40 feet to a point; thence North 04 degrees 00 minutes 00 seconds East, 344.70 feet to the centerline of Norton Road and the true place of beginning and containing 0.7390 acres of land, be the same more or less, but subject to all legal highways.

Property appraised at: One Hundred Thirty-eight Thousand Dollars ($138,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 21st day of July, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
