By virtue of an Order of Sale No. CV2016 10 4585 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 14TH DAY

OF JULY, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Tallmadge, County of Summit and State of Ohio and known as being a part of Lots 2 and 3 in Tract 4 of Tallmadge Township, bounded and described as follows, to wit:

Beginning at point in the centerline of the Akron-Kent Road, said beginning point may be found as follows:

Commencing at a stone at the Northeast corner of said Tallmadge Township; thence North 87 deg. 25' 40" West along the North line of said Tallmadge Township, 3095.75 feet; thence South 4 deg. 16' West, a distance of 2344.40 feet to a marked stone; thence South 39 deg. 53' East 655.25 feet to the center line of said Akron-Kent Road and the true place of beginning; thence North 46 deg. 03' 30" East, along the center line of the said Akron-Kent Road, a distance of 150.00 feet to an iron pin; thence North 39 deg. 53' West, a distance of 245.00 feet to an iron pin; thence North 60 deg. 26' West, 426.09 feet to a marked stone; thence South 39 deg. 53' East, 655.25 feet to the place of beginning. Containing 1.546 acres of land of which 0.04 acre is in Lot 2 and 1.506 acre is in Lot 3, as surveyed by Charles Fish, Surveyor, August 1938.

Note:

Notwithstanding the reference to acreage or square footage in the description set forth in Schedule A hereof, this policy does not insure nor guarantee the acreage or quantity of land set forth therein.

Prior Deed Reference: OR Volume 1768, Page 34 on September 27, 1994.

Property located at: 1421 Northeast Avenue, Tallmadge, OH 44278.

Property appraised at: One Hundred Twenty Thousand Dollars ($120,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 28th day of July, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
