By virtue of an Order of Sale No. CV2012 10 5938 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 14TH DAY

OF JULY, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Real property in the Township of Springfield, County of Summit, State of Ohio and is described as follows:

Known as being in Lot 93 of Lakeview Farms, a proposed allotment of the C. C. Ewart Farm, in Tract 7, and in Lots 21 and 22, Tract 8, in said township, and described as follows:

Beginning at a stone set in the Southwest corner of said Ewart Farm which stone is North 89 degrees 7' West, 1355.80 feet in the prolongation of the South line of said Lot 22 from the Southwest corner of said Lot 22; thence South 89 degrees 7' East, 1064.80 feet to a point in the center line of Oakwood Drive; thence North turning on an angle of 90 degrees along the center line of Oakwood Drive 1740 feet to a point in the center line of Farmdale Road; thence North 89 degrees 7' West, 390 feet to the true place of beginning; thence North turning on an angle of 90 degrees 335 feet to a point; thence North 89 degrees 7' West, 105.94 feet to a point; thence South 3 degrees 50' West, 336.59 feet to a point in the center line of Farmdale Road; thence South 89 degrees 7' East, 123.20 feet to the true place of beginning, subject however, to a perpetual easement in the public to use and improve a strip of land 25 feet in width off the South of the property above described for street purposes, the same to be and constitute the North half of Farmdale Road. Subject to reservations, restrictions, easements, conditions, zoning ordinances if any, of record.

Property located at: 2961 Farmdale Road, Akron, OH 44312.

Property appraised at: One Hundred Eleven Thousand Dollars ($111,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 28th day of July, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
