By virtue of an Order of Sale No. CV2011 08 4229 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 21ST DAY

OF JULY, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

The land referred to in this commitment, situated in the City of Cuyahoga Falls, County of Summit, State of Ohio, is described as follows:

Known as being a part of Lot 38 in former Northampton Township and bounded and described as follows:

Beginning at a point in the West line of said Lot No. 38 North 4 deg. 45' East, 1653 feet from the Southwest corner of said Lot No. 38, said point being the Northwest corner of a 4.5 acre parcel of land owned by E. and M. D. Jackson; thence 82 deg. 43' East, 29.7 feet to an iron pipe found on the North line of said E. and M. D. Jackson's land; thence continuing South 82 deg. 43' East along the Jackson line 195 feet more to an iron pipe; thence North 35 deg. 18' East, 107.5 feet to an iron pipe; thence South 82 deg. 43' East, 210 feet to an iron pipe; thence North 4 deg. 45' East, 105 feet to an iron pin on the South line of land now or formerly owned by M. L. Rugers; thence North 83 deg. 29' West along said South line 489.4 feet to the West line of said Lot No. 38; thence South 4 deg. 45' West, 200 feet along said West line to the place of beginning and containing 1.774 acres of land, be the same more or less, but subject to all legal highways.

Property located at: 2207 Northampton Road, Cuyahoga Falls, OH 44223.

Property appraised at: Two Hundred Forty Thousand Dollars ($240,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 4th day of August, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
