By virtue of an Order of Sale No. CV2017 02 0697 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 4TH DAY

OF AUGUST, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Coventry, County of Summit and State of Ohio:

And known as being Lots 366, 367 in the Sawyer and Haynes Cottage Grove Allotment No. 4, recorded in Plat Book 32, Pages 10, 11 and 12, Summit County Records of Plats. Be the same more or less, but subject to all legal highways.

PARCEL 2:

Situated in the Township of Coventry, County of Summit and State of Ohio:

And known as being a part of Tract Number 13 and more fully described as follows:

Beginning at a point in the Westerly line of Bender Street, at the Southeastern corner of Lot Number 366 of the Cottage Grove Allotment No. 4, recorded in Plat Book 32, Pages 10-12 inclusive, Summit County Records; thence Westerly along the Southern line of said Lot 366 and Lot 367 of said allotment, about two hundred and seventeen and No/100 (217.00) feet to the Southwestern corner of said Lot 367; thence Southerly along the Southerly extension of the Eastern line of Willowedge Street as established in said allotment, about fifty and 2/100 (50.02) feet; thence Easterly, parallel to and about fifty feet Southerly from said Southern line of Lots 366 and 367, about two hundred nineteen and 39/100 (219.39) feet to a point in the Western line of Bender Street; thence Northerly fifty and 13/100 (50.13) feet to the place of beginning, containing .4982 acres of land, be the same more or less, but subject to all legal highways.

Property located at: 3318 S. Bender Avenue & Willowedge Street, Akron, OH 44319.

Property appraised at: Ninety Thousand Dollars ($90,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 18th day of August, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
