By virtue of an Order of Sale No. CV2016 05 2481 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 18TH DAY

OF AUGUST, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being Lot 350 in Goodyear Heights Allotment as recorded in Plat Book 16, Pages 23-27, Summit County Records.

Expecting therefrom:

Situated in the City of Akron, County of Summit and State of Ohio and known as being a part of Lot 350 in the Goodyear Heights Allotment, Plat Book 16, Page(s) 24-27, of the Summit County Record of Plats and being a corner rounding needed for sidewalk purposes more fully described as follows:

The true place of beginning being the Southeasterly corner of said Lot 350; thence Northwesterly along the Northerly line of Malasia Road (50' R/W), N. 89 degrees 10' 04" W., 6.10 feet to a point of curve; thence Northeasterly through Lot 350 and along the arc of a circle curving to the left (central angle = 91 degrees 47' 46", radius = 6.00', chord = 8.62", chord bearing = N. 44 degrees 56' 04" E.) 9.61 feet to the Westerly line of Ruckel Road (50' R/W); thence Southeasterly along the Westerly line of Ruckel Road, and along the arc of a circle curving to the right (central angle = 01 degrees 46' 16", radius = 200.83', chord = 6.19, chord bearing = S. 00 degrees 04' 42" E.) 6.19 feet to the true place of beginning for the land hereinbefore described and containing 8 square feet of land as surveyed by the City of Akron, Bureau of Engineering, in August of 1995. The bearings in the above description are based on the Ohio Plane Coordinate System, North Zone.

Property located at: 1507 Malasia Road, Akron, OH 44305.

Property appraised at: Seventy-eight Thousand Dollars ($78,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 1st day of September, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
