By virtue of an Order of Sale No. CV2016 12 5151 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 22ND DAY

OF SEPTEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio and known as being a part of Lot 2, Tract 4, formerly Springfield Township and being that land now owned by James R. Coles recorded in Reception Number 55095623 of the Summit County Records and part of vacated Fulmer Avenue (City Ordinance No. 835-1985) and being more fully described as follows:

Beginning at a 1 inch iron pin found at the Northwesterly corner of Lot 54, A.P. Walker Allotment as recorded in Plat Book 16, Page 37 of the Summit County Record of Plats; Thence Northeasterly along the Easterly line of Fulmer Avenue (45' R/W), North 01 deg. 17' 05" East (bearings referenced to the Ohio Coordinate System, North Zone, NAD 83), 193.05 feet to a Yz" iron pin found at the Southwesterly corner of said land owned by James R. Cole and being the True Place of Beginning for the land hereinafter described; Thence continuing along the Easterly line of Fulmer Avenue, North 01 deg. 17' 05" East, 89.05 feet to a number five rebar set (capped "KALSTROM, P.S. 6302) at the Northerly end of Fulmer Avenue; Thence North 88 deg. 42' 55" West, 22.50 feet to the centerline of Fulmer Avenue; Thence Northeasterly along the centerline of said vacated Fulmer Avenue North 01 deg. 17' 05" East, 3.85 feet to a point; Thence South 88 deg. 42' 55" East, 25.50 feet to a point; Thence North 01 deg. 17' 05" East, 4.84 feet to a number five rebar set (capped "KALSTROM, P.S. 6302); Thence North 81 deg. 42' 35" East, 84.15 feet to a point in Springfield Lake Outlet; Thence North 61 deg. 50' 06" East, 98.14 feet to a point in Springfield Lake Outlet and the Northeasterly corner of said land owned by James R. Cole; Thence Southwesterly along the Easterly line of said Cole land (passing over a number five rebar set at 25.00'), South 07 deg. 52' 43" West, 161.94 feet to a number five rebar set (capped "KALSTROM, P.S. 6302) at the Southeaserly corner of said Cole land; Thence Northwesterly along the Southerly line of said Cole land, North 88 deg. 23' 03" West, 152.85 feet to the True Place of Beginning for the land hereinbefore described and containing 0.4420 acres of land as surveyed by Daniel C. Kalstrom, Professional Surveyor (Reg. No. 6302) in June, 2013 and being subject to all legal highways, easements and restrictions of record.

Property located at: 261 Fulmer Avenue, Akron, OH 44312.

Property appraised at: Eighty-four Thousand Dollars ($84,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 6th day of October, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
