By virtue of an Order of Sale No. CV2017 01 0337 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 22ND DAY

OF SEPTEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being the Westerly 150 feet of the following described premises:

Being a part of Original Coventry Township Lot No. 18 in Tract No. 10 and bounded and described as follows:

Commencing at the Northwesterly corner of a 1-69/100 acre tract of land conveyed by Sarah Wingarter to Julia Brodt in July, 1900, said Northwesterly corner of land 1-69/100 acre tract of land conveyed to Julia Brodt is at the intersection of the Easterly prolongation of the Northerly line of Lot No. 38 in the Brodt Allotment as recorded in Plat Book 8, Page 26 of Summit County Records, with the center line of Manchester Road; Thence North 6 deg. 45' West 45 feet to the principal place of beginning; Thence South 83 deg. 43' East on a line parallel to the Northerly line of said 1-69/100 acre tract 325 50/100 feet to a Westerly line of said Brodt Allotment; Thence Northerly along the Westerly line of said Brodt Allotment, 55 feet; Thence North 83 deg. 43' West 330 30/100 feet to the center line of said Manchester Road; Thence South 6 deg. 43' East along the center line of said Manchester Road, 55 feet to the place of beginning and contains 41/100 of an acre of land; Be the same more or less, but subject to all legal highways, restrictions and assessments of record; it being the intention of the Grantor to convey to the Grantees the Westerly 150 feet commencing from the center of Machester Road.

Property appraised at: Forty-two Thousand Dollars ($42,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 6th day of October, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
