By virtue of an Order of Sale No. CV2017 02 0833 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 29TH DAY

OF SEPTEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Franklin, County of Summit and State of Ohio:

And known as and being part of the Northwest quarter of Section 26 of Original Franklin Township and all of Lots Forty-nine (49) and Fifty (50) and part of Lot Fifty-one (51) Village of Manchester as shown on transcribed records, Page 25 of Summit County Record of Plats and described as a whole as follows:

Beginning at the Southeast corner of said Lot 49; thence North 17 deg. 56' West, a distance of 139.23 feet on the Northeasterly line of said Lots 49, 50 and 51; thence South 87 deg. 32' West, a distance of 134.75 feet to a point within said Lot 51; thence North 1 deg. 48' West, a distance of 142.00 feet; thence North 88 deg. 54' West, a distance of 98.20 feet; thence South 18 deg. 27' 17" East, a distance of 164.65 feet; thence North 72 deg. 11' East, a distance of 20.00 feet to the Northwest corner of said Lot 51; thence South 17 deg. 56' East, a distance of 180.00 feet to the Southwest corner of said Lot 49; thence North 72 deg. 11' East, a distance of 160.00 feet to the place of beginning, be the same more or less, but subject to all legal highways. And that part of vacated street from vacation ordinance resolution 1235-76.

Property appraised at: Ninety-three Thousand Dollars ($93,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 13th day of October, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
