By virtue of an Order of Sale No. CV2017 03 1091 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 29TH DAY

OF SEPTEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio, and known as being part of Lots Nos. 88 and 89 in an allotment made for Samuel Bacon, the plat of which is recorded in the Recorder's Office of Summit County, Ohio, in Plat Book 11, Page 1, bounded and described as follows:

Beginning in the East line of said Lot No. 89, which is also the West line of Noble Avenue, 40.00 feet South of the Northeast corner of said Lot No. 89; thence South along the East line of said Lot No. 89, which is also the West line of Noble Avenue, 40.00 feet; thence West parallel to the South line of said Lots Nos. 89 and 88, 104.50 feet to the West line of said Lot No. 88; thence North along the West line of said Lot No. 88, 40.00 feet; thence East parallel to the North line of said Lots Nos. 88 and 89, 104.50 feet to the place of beginning.

Deed Reference Number: Dated June 10, 2008, filed June 11, 2008, recorded as Instrument Number 55549311, Summit County, Ohio records.

Property located at: 116 Noble Avenue, Akron, OH 44302.

Property appraised at: Sixty-nine Thousand Dollars ($69,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 13th day of October, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
