By virtue of an Order of Sale No. CV2017 01 0458 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 6TH DAY

OF OCTOBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio, and bounded and described as follows, to wit:

Being part of Lots 350, 351 and 353 in Allenside Allotment Number Two as recorded in Plat Book 25, Page 75-77, Summit County Records, and more fully described as follows:

Beginning at a point in the West line of Nesmith Lake Boulevard at the Northeast corner of Lot 350; thence Westerly along the North line of Lot 350, 87.11 feet to a point by actual computation 7.9 feet Easterly of an angle in said line; thence Southerly parallel to the West line of Lots 350 and 353, 44.93 feet to a point; thence Easterly parallel to the North line of Allenford Street, 50 feet to a point; thence continuing Easterly on a line which is at right angles to the West line of Nesmith Lake Boulevard, 51.33 feet to a point in the West line of Nesmith Lake Boulevard; thence Northerly along the West line of Nesmith Lake Boulevard, 50 feet to the place of beginning.

Prior Deed Reference: Reception No. 55091455 on August 25, 2004.

Property located at: 2232 Nesmith Lake Blvd., Akron, OH 44314.

Property appraised at: Fifty-one Thousand Dollars ($51,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 20th day of October, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
