By virtue of an Order of Sale No. CV2006 10 6707 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 13TH DAY

OF OCTOBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Springfield, County of Summit and the State of Ohio:

Situated in the Township of Springfield, County of Summit, State of Ohio and known as being a part of Tract 5, Township 1 North, Range 10 West, and known as being all of Lots 116 and 117 of the Peterboro Subdivision as recorded in Plat Book 35, Pages 36 and 37, also being a part of Vacated Scenic Drive, Ordinance No. 422-73 of said county's records, and being further bounded and described as follows:

Commencing at an iron pin found at the Southwest corner of said Lot 116, said iron pin found being the true place of beginning of the parcel of land hereinafter described; thence clockwise along the following four (4) courses and distances:

1.) Thence along the West line of said Lots 116 and 117 due North for a distance of 707.51 feet to a point on the centerline of said Vacated Scenic Drive, (passing over iron pins found at distances of 90.00 feet and 180.00 feet);

2.) Thence along said centerline, N. 89 deg. 12' 34" E., for a distance of 484.23 feet to a point;

3.) Thence due South along the East line of said Lots 117 and 116 for a distance of 714.19 feet to an iron pin found at the Southwest corner of said Lot 116, (passing over iron pins found at distances of 449.17 feet, 534.19 feet and 624.19 feet);

4.) Thence due West along the South line of Lot 116 for a distance of 484.18 feet to the true place of beginning and containing 7.9013 acres of land, more or less, and subject to all easements, restrictions and covenants of record as surveyed under the supervision of Jeffrey B. Freeman, P.S. Number 7925 in May of 2003. Basis of bearing is to an assumed meridian and is used to delineate angles only.

Property located at: 1701 Owego Drive, Akron, OH 44312.

Property appraised at: Ninety-six Thousand Dollars ($96,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 27th day of October, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
