By virtue of an Order of Sale No. CV2017 05 2070 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

And known as being a part of the Southwest quarter of Section 12 of said township and bounded and described as follows:

Beginning at a point on the centerline of Spade Road on the quarter section line, said point being Westerly and 231 feet distance from the Northeast corner of the Southwest quarter of Section 12; thence South 4 deg. 30' along road center a distance of 41.92 feet to an angle point in roadway; thence South 66 deg. 32' West along road center a distance of 32.14 feet to a point; thence South 3 deg. 53' West, a distance of 425 feet to an iron stake and the true place of beginning; thence South 88 deg. 50' East, a distance of 255.23 feet to an iron stake on edge of railroad right of way; thence South 12 deg. 57' West along railroad right of way a distance of 533.7 feet to an iron stake; thence North 85 deg. 19' West, a distance of 171.76 feet to an iron stake; thence North 3 deg. 53' East, a distance of 512.5 feet to an iron stake; the true place of beginning and containing within said boundaries an area of 2.544 acres. Beginning at a point in the center of Spade Road on the quarter section line, said point being 231 feet West of the Northeast corner of the Southwest quarter of Section 12; thence South 4 deg. 30' West along center of Spade Road, a distance of 41.92 feet to an angle point in road; thence South 66 deg. 32' West along center of Spade Road, a distance of 32.14 feet to a point and the true place of beginning; thence South 66 deg. 32' West along center of Spade Road, a distance of 107.54 feet to a point; thence South 3 deg. 53' West, 886.77 feet to an iron stake; thence South 85 deg. 19' East, 95.53 feet to an iron stake; thence North 3 deg. 53' East, 937.50 feet to a point in the center of Spade Road and the true place of beginning and containing within said boundaries 2 acres of land, be the same more or less. TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 3rd day of November, 2017. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
